The courts won't look at anything unless it's registered in the first place, but the barrier is pretty low. I think it's a single form and a $200 fee or so. Until the 1970's it was pretty much like this.
The default change to 'everything' is copyrighted was made in the 1970's and it's rather dangerous. It means every email, letter, and word from our mouths is regulated by copyright law.
