The health insurer Anthem warned on Wednesday that it would consider lea=
ving some federal health care marketplaces or raising its rates sharply i=
f the government does not continue subsidies to help low-income people. J=
oseph Swedish, the company's CEO, set a deadline of early June for a deci=
sion on the subsidies, saying Anthem would weigh increasing rates by at l=
east 20 percent next year. While Republicans successfully sued the Obama =
administration to discontinue funding the payments, the decision is on ap=
peal, and President Donald Trump has recently indicated that he wants to =
use the subsidies as a bargaining chip with Democrats. On Wednesday, Repu=
blican leaders were seeking to assure Democrats that the subsidies would =
continue to be funded, although there was no guarantee. If the subsidies =
ended in 2018, the lack of funding "would cause further market instabilit=
y," Swedish said, which would make the company's participation in the fed=
eral market "even more challenging."

Pharmacists across Utah on May 1 will begin placing red stickers atop op=
ioid analgesic containers as part of a new Utah Department of Health (ODO=
H) program aimed at warning customers about the dangers of addiction. UDO=
H's new Talk To Your Pharmacist Month in May will encourage pharmacists t=
o start a dialogue with customers about the risks of opioids. "Given the =
high number of deaths associated with prescription opioids, understanding=
the risks of opioids is vital to patient safety," says Angela Dunn, depu=
ty state epidemiologist for UDOH. The initiative is a collaboration betwe=
en UDOH, the Utah Pharmacy Association, and the Utah Department of Commer=
ce. The stickers are meant to prompt those prescribed opioids to ask phar=
macists questions about their medications, says Greg Jones, director of p=
harmacy for Harmons and chairman of the Utah Pharmacy Licensing Board.

Biomarin Pharmaceuticals said Thursday that the annual price for cerlipo=
nase alfa (Brineura), its newly approved drug for a form of Batten diseas=
e, is expected to be $486,000 after mandatory government discounts and re=
bates. The drug company said it will offer a copay program to help with o=
ut-of-pocket costs for the enzyme replacement therapy. Biomarin also said=
it expects European approval of the medication at the end of this quarte=

m, he said, adding that unlike its more diversified competitors, "100 per=
cent of our focus is on drug costs and pharmacy." Express Scripts' major =
competitors say their integration with other supply-chain players enables=
them to more comprehensively manage drug spending and provide better cus=
tomer service.

artphone, to allow drug-company officials to monitor the progress of drug=
-development and sales and aid in decision-making, explains Tal Rosenberg=
, QuintilesIMS's senior vice president for global technology solutions. H=
e adds that drug companies could mine data in the new platform to identif=
y research sites suitable for conducting clinical trials for experimental=
drugs, and then track the progress of the testing. Drug companies that d=
evelop plans for selling an approved drug could also use the platform to =
identify doctors who treat patients with the targeted disease and the bes=
t ways to market to them, as well as determine which health plans would p=
ay for the prescriptions. In addition, drug companies, hospitals, and hea=
lth insurers could use social-media postings and other data in the platfo=
rm to identify patients who would benefit from a treatment or may be at r=
isk of halting use without intervention, according to Rosenberg.

Mylan's business practices have been under a microscope after it was fou=
nd the pharmaceutical company inflated EpiPen prices by 450 percent since=
2004. The drugmaker has been scrutinized for allegedly overcharging stat=
e Medicaid departments for the epinephrine autoinjector and interfering w=
ith generic competition, among other questionable actions. Just now comin=
g to light, however, is litigation it quietly lodged against West Virgini=
a in 2015, after the state moved to scrub EpiPen from its "preferred drug=
list." Late that year, decision-makers there agreed to transfer preferre=
d status to Auvi-Q, a rival product viewed as easier to use and less expe=
nsive. A slot on the preferred drug formulary ensures that Medicaid autom=
atically pays for a treatment, while drugs not on the list are covered on=
ly with prior authorization. Mylan argued that the decision to revoke Epi=
Pen's preferred status was made illegally in secret; and it told the cour=
t that the company would suffer irreparable harm to its reputation and ma=
rket share and that patients could suffer, too. A judge rejected Mylan's =
request for a preliminary injunction against the change; but the firm lat=
er regained its preferred status, after Auvi-Q was voluntarily taken off =
the market for dose-delivery problems. The victory was temporary, however=
, as a growing number of state Medicaid programs=E2=80=94including West V=
irginia's=E2=80=94has since taken EpiPen out of the preferred category in=
response to its escalating cost.

Soaring insulin prices and inflexible insurance policies have prompted m=
any families to take desperate measures such as turning to the black mark=
et for the medication. Some parents are trading for the medication with o=
ther families with diabetes they meets online, a tactic that regulators a=
nd health experts warn is a health risk. Every insurance provider typical=
ly has one insulin that is their "preferred" brand, based on the best dea=
l they are able to negotiate with insurers through their contracted PBMs,=
says David Mitchell, cofounder of Patients for Affordable Drugs, a nonpr=
ofit advocacy group. To keep plan costs down for everyone, an insurance p=
ractice called "tiering" makes affordable the brand of a drug with the lo=
west cost but comparable effectiveness, says Aaron Kesselheim, MD, a prof=
essor of medicine at Harvard Medical School. If patients choose the more =
expensive drug, they can still get it at the pharmacy, but they will pay =
several times more out-of-pocket.

Mylan of artificially inflating the price of the EpiPen to maintain a mar=
ket monopoly. "To preserve the monopoly position of their $1 billion crow=
n jewel branded drug product, Mylan engaged in illegal conduct to squelch=
this nascent competition, harming both Sanofi and U.S. consumers," Sanof=
i's lawyers said in the filing. Sanofi also said Mylan executives offered=
"unprecedented" price rebates to persuade government officials, insuranc=
e companies, and PBMs not to reimburse patients for Sanofi's rival Auvi-Q=
allergy treatment. Sanofi alleged that Mylan ran misleading ads to convi=
nce doctors to avoid prescribing Auvi-Q and required schools to certify t=
hey would use EpiPen exclusively in order to access discounts.

A new study from Centers for Disease Control (CDC) suggests the total nu=
mber of opioid-related deaths in the United States may be underestimated.=
Researchers=E2=80=94led by Victoria Hall, a CDC field officer based in M=
innesota=E2=80=94examined death records within the Minnesota Department o=
f Health's Unexplained Death surveillance system for 2006 through 2015. T=
he team looked for pneumonia and other infectious disease deaths among re=
sidents older than aged 12 years to see whether opioids could be involved=
and found in post-mortem toxicology screenings. Among more than 1,600 de=
aths that fit the criteria, 59 showed evidence of opioid use; however, th=
ose deaths had not been included in the state's opioid surveillance syste=
m because they lacked the proper ICD-10 code. Twenty-two of those deaths =
involved toxic levels of opioids. The deceased ranged in age from 16 year=
s to 82 years, with a median age of 43 years. Thirty-two of the deaths in=
volved pneumonia. Hall noted that deaths involving infectious diseases su=
ch as pneumonia can be complicated if there are opioids in one's system.

. Stifel analyst Annabel Samimy said Valeant appears to want to price Sil=
iq more reasonably relative to ixekizumab (Taltz=E2=80=94Eli Lilly and Co=
.) and secukinumab (Cosentyx=E2=80=94Novartis), which are priced at about=
$6,000 and $5,400 per month, respectively. Samimy noted that this is jus=
t the list price, however=E2=80=94"it's neither here nor there unless you=

With a vote of 14-9, a Senate panel voted Thursday to back the confirmat=
ion of Scott Gottlieb, MD, as head of the Food and Drug Administration (F=
DA). Senators who voted against the nomination expressed concern about Go=
ttlieb's connections to medical companies. "I have grown increasingly con=
cerned about whether Dr. Gottlieb can lead the FDA in a non-biased way," =
said Sen. Patty Murray (D-Wash.), the ranking Democrat on the Senate Comm=
ittee on Health, Education, Labor and Pensions. "The extent of Dr. Gottli=
eb's entanglements with the industry he will be regulating is unprecedent=
ed." Gottlieb has said he plans to divest himself of any potential confli=
cts of interest and recuse himself from FDA decisions on more than 20 com=
panies. Other senators said they considered Gottlieb's industry dealings =
an advantage, not a problem. A full Senate vote on his confirmation is ex=
pected in May.

U.S. Supreme Court justices on Wednesday heard arguments in an appeal by=
Novartis AG of a lower court decision that prevented the Swiss pharmaceu=
tical company from selling its biosimilar version of Amgen's filgrastim (=
Neupogen) until 6 months after FDA approved it. The ruling in the case, d=
ue by the end of June, could determine how quickly patients have access t=
o biosimilars at potentially cheaper prices. The case involved a section =
of the Affordable Care Act that created an expedited path for regulatory =
approval of biosimilar drugs. The justices assessed the complex law and h=
ow Congress intended to balance the patent rights of brand-name manufactu=
rers and the ability of biosimilar drug makers to bring copycat products =
to the market. "We are being asked to interpret very technical provisions=
that I find somewhat ambiguous and am operating in a field I know nothin=
g about," said Justice Stephen Breyer. "But it's going to have huge impli=
cations for the future." Novartis complained that the lower court ruling =
favoring Amgen gave the brand-name manufacturer an extra 6 months of excl=
usivity on top of the 12 years already provided under federal law. The ju=
stices gave little indication as to how they would rule.

More than 400 independent pharmacies nationwide have sued Optum Rx, alleg=
ing the PBM sets unreasonably low reimbursement rates, based on irrelevan=
t, inapplicable, or outdated pricing information. In court documents, the=
pharmacies claim that Optum's bad faith and lack of transparency effecti=
vely put their business and continued provision of patient services at ri=
sk. Among their claims, the pharmacies allege that Optum consistently pay=
s pharmacies maximum allowable cost (MAC) prices below the pharmacy's acq=
uisition cost, in violation of its contract with the pharmacies; required=
pharmacies who appealed below cost reimbursement to submit and document =
their invoice cost when they appealed MAC price; and for many drugs, Optu=
m Rx allegedly pays the pharmacy a very low MAC price, while also billing=
the health plan a much higher brand name price.

Columbia Pharmacies Begin Using Drug Monitoring Program

In March, the Columbia City Council in Missouri passed an ordinance to es=
tablish a database that tracks Schedule II and Schedule IV drugs to preve=
nt "doctor shopping" and curb opioid addiction. The prescription drug mon=
itoring program (PDMP) went live on April 25. The St. Louis County Health=
Department established the system after years of inaction at the state l=
evel, and allowed other cities and counties to join in. In all, 17 other =
cities and counties had their systems go live on Tuesday. A PDMP was just=
approved in Boone County last week, and its system will be active on Jul=
y 1. Julia Chisholm, manager of outpatient pharmacies at University of Mi=
ssouri Health Care, said most patients use their medications appropriatel=
y; but the system gives pharmacists and doctors the ability to know exact=
ly what their patients are taking to ensure they are safe. "If anything, =
it is a relief or a little bit of reassurance that their fill history is =
legitimate and appropriate, and that helps build a trusting relationship =
with the pharmacist, provider, and the patient," she said. "Before, it's =
always been a gray area and you hope your patient is telling you the trut=
h." Pharmacists in Columbia report that the system has been working seaml=
essly so far.

Marsh Supermarkets to Close All of its Pharmacies

Marsh Supermarkets plans to shutter all 37 of its in-store pharmacies in =
Indiana. The closures will take place over a 3-day period starting May 3.=
Marsh will transfer all patient prescription information and pharmacy in=
ventory to CVS Pharmacy. In a statement, CVS noted the two companies "wil=
l work together to ensure that pharmacy patients experience a seamless tr=
ansaction with no interruption of service. Each Marsh location will have =
signage with the location of the nearest CVS Pharmacy. However, any CVS P=
harmacy location will be able to fill prescriptions for Marsh's pharmacy =
patients." One news report on the closures said that Marsh has been closi=
ng stores in Indiana because of "weak performances."

In Pennsylvania's Greater Lehigh Valley, Health Network Laboratories (HNL=
) recently opened laboratories inside two independent pharmacies. Custome=
rs at Hartzell's Pharmacy in Catasauqua and South Mountain Pharmacy in Al=
lentown can now get blood work and other lab services done when they drop=
off a prescription. Peter Fisher, CEO of HNL observes: "People coming to=
a pharmacy are already seeking some form of health care service, so this=
would be like a one-stop shop where you get your prescription filled and=
equipment supplies and at the same time you could get your blood work do=
ne." HNL's pharmacy labs provide the same services as its more than 50 fr=
ee-standing laboratories, known as patient service centers, located throu=
ghout central and eastern Pennsylvania and New Jersey. The company leases=
space at the pharmacies and staffs it with one of its employees. HNL cou=
riers pick up and deliver testing samples to its main testing site. The c=
ompany plans to focus on independent pharmacies for now for launching its=
partnerships, although it will not rule out other kinds of markets, Fish=
er says. HNL expects to open more such labs in the region over the coming=
months.
