Below is a rough draft for an item on the hearings this Friday. Please expand and revise at will.

On Friday May 2, at approximately 10AM, NYFairUse will address the U.S. Copyright Office. Ruben Safir will represent NYLXS's stakeholders rights movement on the topic of "DVD tethering and alternative platforms" during the Motion Pictures and Audiovisual Works segment of the Anticircumvention Hearing. The hearing will take place at the Postal Rate Commission office, 1333 H Street, NW, Third Floor, Washington, DC.
This hearing is one of a series being conducted on behalf of the Librarian of Congress in response to the mandates of the Digital Millenium Copyright Act (DMCA). The DMCA creates criminal penalties against the circumvention of technological measures used to control and limit access to copyrighted material. The U.S. Copyright Office is a part of the Library of Congress, and the Librarian of Congress is charged with determining what exemptions from the prohibitions created by the Act should be allowed. At this time the allowable exemptions are:
1. Compilations consisting of lists of websites blocked by filtering software applications; and 2. Literary works, including computer programs and databases, protected by access control mechanisms that fail to permit access because of malfunction, damage or obsolescence.
The mission of the Copyright Office is described on their site by the following quote from Article I, Section 8 of the U.S. Constitution:
"To promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries"
Mr. Safir will be appearing on the same day as representatives from the Motion Picture Association of America and AOL Time Warner, neither of whom are authors or inventors of any Writings or Discoveries. Mr. Safir, in his capacity as founder of NYFairUse, will represent the American people, who are the real stakeholders in all issues of copyright and information ownership.
