The key here is do they redistribute it as binaries if the do they have to supply the source for every modification the made.
Further more it is then at the option of the upstream project to absorb those changes into the upstream code.
Once that happens than yes the owner of the upstream project owns the modifications; However the owner of the upstream project can not make it closed source without removing all code contributed under the terms of the GPL
