The key here is do they redistribute it as binaries if the do they have to = supply the source for every modification the made. Further more it is then at the option of the upstream project to absorb tho= se changes into =E2=80=8Ethe upstream code. Once that happens than yes the owner of the upstream project owns the modif= ications; However the owner of the upstream project can not make it closed = source without removing all code contributed under the terms of the GPL
