When will the legal action take place? I see no value in freaking out, and you are otherwise preaching to the choir. How about filing with ICANN and possibly whatever court is responsible for such issues? At the very least you could get an injunction requiring them to refrain from using these names, and ideally you would get permanent use of both NYLXS.org and NYFairUse.
Otherwise there is little to prevent them from doing what you are doing, which is to use the names as they see fit.
Unless you enjoy getting angry and prolonging the issue, I don't see what further steps NYLXS can take at this point besides using the legal system.
